Claims Against the City

If you believe the City of Fort Collins (or its employees) injured you or damaged your property, Colorado law requires you to file a written Notice of Claim before you can sue the City. The City's claim form meets this Notice of Claim requirement.

Note: You must file the claim within 182 days of when you discovered the injury or damage.

In Colorado, state and local governments have immunity from many civil claims. Successful claims must meet the notice requirements in the Colorado Governmental Immunity Act ("CGIA"), fall within a category where immunity has been waived, and prove the government's negligence caused the damages or injuries.

Damage Caused by City Contractors

City contractors are responsible for damage they cause. Safety and Risk Management can help community members by providing contractor contact information when requested. Email Safety and Risk Management for help if your claim involves a contractor.

Waste Removal and Recycling

Republic Services contracts with the City of Fort Collins for waste removal and recycling. Republic Services handles claims against them directly.

To file a claim against Republic Services, call their Customer Care Center at 970-416-2012 or email fortcollinservice@republicservices.com.

Insurance

You may want to contact your insurance company about coverage. If your insurance company believes the City is liable, it will settle the claim with you and seek reimbursement from the City. If the City is later found responsible for the damage, the City will reimburse your insurance company for money it advanced. Your insurance company must reimburse any deductible you paid.
